Version and last updated: 2026-10-24 (free pilot)
1. Who we are. The Copyspot free pilot is run by Miguel Garcia, an individual based in Portugal, email contact@getcopyspot.com ("Copyspot", "we"). See also the Provider details and the Privacy notice.
2. What we provide. If your request is within the scope of the pilot, we email you a free self-help kit in PDF, made by hand. It contains:
- a general guide with links to each platform's own report pages;
- an evidence checklist;
- a template with the facts you gave us in writing, copied word for word.
The kit is generic and provided as it is. We only fill in facts you gave us, as you gave them. We do not review the legal merits of your case, tell you whether a listing breaks your rights, choose the type of report or suggest legal grounds or wording for your case. It is not legal advice. You decide whether to report, and you submit any report yourself, from your own account.
The pilot is open to a small number of artists. We may decline a request, for example if it is not covered (see the Artist declaration) or if the pilot is full. If we answer your questions by email, we only point you to the kit and to the platform's own pages.
3. Free of charge. This pilot kit is free. We will not ask you for a payment, a deposit or card details for it. We may ask, in the form or in the kit, "Would you pay for a kit like this? If so, how much, and why?". Answering is optional, does not affect your kit, is not an offer and binds neither you nor us.
4. Your responsibilities. You are responsible for the Artist declaration, for deciding whether to report, for the content of your report and for submitting it. Give us only accurate information that you are allowed to share. Describe the listing factually as an "alleged copy", without accusations about the seller.
5. Liability.
- (a) Nothing in these terms excludes or limits our liability for wilful misconduct or gross negligence, for death or personal injury, for non-contractual damage to you or to third parties, or any liability that cannot be excluded or limited under the law that applies to you.
- (b) You decide whether to report and what your report says. We are not responsible for that decision or for its outcome.
- (c) We are not responsible for what platforms or sellers do with your report.
6. Applicable law. These terms are governed by Portuguese law. If you are a consumer, this choice does not deprive you of the protection of the mandatory rules of the country where you habitually live (Regulation (EC) 593/2008, Article 6(2)).
7. Courts. These terms do not choose an exclusive court. A dispute can be brought before the courts that have jurisdiction under the law that applies. If you are a consumer living in the EU, you can bring proceedings against us in Portugal or in the courts of the place where you live, and we can only bring proceedings against you in the courts of the country where you live (Regulation (EU) 1215/2012, Articles 17 and 18).
8. Changes. We may change these terms for future requests by publishing a new dated version. A request already sent stays under the version in force when it was sent.
9. End of the pilot. We may end the pilot at any time, for example once it is full. Kits already sent remain yours. We keep or delete data as the privacy notice says (kit and screenshots 12 months; signed declaration 3 years).

Artist declaration (as ticked in the form)
Help text: Please read and tick each box. We only send a kit if all boxes are ticked. We are not lawyers. This is not legal advice. We keep your signed declaration (with its date, your email and the case reference) for 3 years after we deliver your kit, separately from the rest, as evidence if a seller disputes the case. See the Privacy notice.
- I own the rights or I'm authorised. I own the copyright in the original work I linked (I created it and have not transferred the rights), or I'm authorised by the owner to act for them. As far as I know, I have not licensed, sold or given permission for this use.
- I've considered allowed uses. Before asking for the kit, I asked myself:
- Does the listing copy my actual artwork, or only a similar idea, theme, technique or style?
- Could it be parody, caricature or pastiche?
- Could it be a quotation, review or commentary?
- Could it be fair use (if US law applies), for example because it transforms the work or uses only a small part?
- Did I, or anyone acting for me, ever sell a licence, accept a commission or give permission that could cover this use?
- Could the seller have made it independently, or from a public domain source?
If I'm not sure about any of these, I'll talk to a lawyer before I submit a report. - My report, my decision. I choose the type of report, check every statement, and sign and submit it myself from my own account. I'm responsible for what the report says. I understand that: - in a US copyright (DMCA) notice, I state in good faith that the use is not authorised, and under penalty of perjury that I'm the owner or authorised to act for the owner (17 U.S.C. 512(c)(3)(A)(v) and (vi)); - anyone who knowingly and materially misrepresents that material is infringing can be liable for damages, including costs and attorneys' fees (17 U.S.C. 512(f)); - platforms can reject reports made in bad faith and can stop accepting reports from people who often send clearly unfounded ones. - The seller may see my name. The platform may give the seller my report and my name and contact details: Etsy and eBay say they share at least my name and email. If the seller sends a counter-notice, the listing may come back after about 10 to 14 days unless I go to court (17 U.S.C. 512(g); Etsy says 10 business days; each platform sets its own period). - What Copyspot is not. Copyspot is not a law firm. We are not lawyers. Copyspot does not give legal advice, does not assess my case or tell me whether the listing breaks my rights, does not choose the type of report, does not act for me, and never submits anything or contacts the seller. The kit is a generic self-help kit with my facts filled in as I gave them. It does not replace a lawyer. - Free pilot kit, no promise. This pilot kit is free. I will not be asked for a payment, a deposit or card details for it. The question "Would you pay for a kit like this?" is an optional survey: leaving it blank does not affect my kit, it is not an offer, and it binds neither me nor Copyspot. Copyspot does not promise that any listing will be removed. - Not covered. The kit does not cover counter-notices or disputes, trademark reports, fan art, derivative works or other unclear cases. For these I'll talk to a lawyer or use the platform's help pages. - Terms. I accept the Terms of use of the kit.
